Jesolo Real Estate, as the data controller of personal data in accordance with Legislative Decree 196/2003 and subsequent amendments – “Privacy Code” – and EU Regulation 679/2016 applicable from 25 May 2018 – General Data Protection Regulation (“GDPR”), recognises the importance of the protection of personal data and considers its protection one of the main objectives of its business.

Before communicating any personal data, Jesolo Real Estate invites you to carefully read this privacy policy, as it contains important information on the protection of personal data and on the security measures adopted to ensure their confidentiality in full compliance with the applicable legislation.

This privacy policy is intended only for the site www.jesolorealestate.it and does not apply to other websites that may be consulted through external links; it is intended as information provided pursuant to art. 13 of the applicable legislation to those who interact with the Site; it complies with Recommendation no. 2/2001 on minimum requirements for collecting data on-line in the European Union, adopted on 17.5.2001 by the Article 29 Working Party.

Jesolo Real Estate informs you that the processing of your personal data will be based on the principles of lawfulness, correctness, transparency, purpose limitation and conservation, data minimisation, accuracy, integrity and confidentiality. Your personal data will therefore be processed in accordance with the provisions of the applicable legislation and the confidentiality obligations therein.

Types of data processed

Personal Data’ shall mean any information relating to an identified or identifiable natural person with particular reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more characteristic elements of that person’s physical, physiological, mental, economic, cultural or social identity.

The Personal Data collected when browsing the www.jesolorealestate.it website are as follows:

a) navigation data. The computer systems and software procedures used to operate the website www.jesolorealestate.it acquire, during their normal operation, some personal data whose transmission is implicit in the use of Internet communication protocols.

This information is not collected in order to be associated with identified interested parties but, by its very nature, could, through processing and association with data held by third parties, allow users to be identified.

This data is used for the sole purpose of obtaining anonymous statistical information on the use of the website, to check its correct operation and to allow the correct provision of the various functions requested by you. The data could be used to ascertain responsibility in the event of hypothetical computer crimes to the detriment of the website.

b) Data provided voluntarily by the user. Through the website www.jesolorealestate.it you have the opportunity to voluntarily provide personal data such as your name, surname and e-mail address through the “Contact us” forms. The Controller will process this data in compliance with the applicable legislation, assuming that it relates to you or to third parties who have expressly authorised you to provide it on the basis of a suitable legal basis legitimising its processing. With respect to such hypotheses, you act as an autonomous data controller, assuming all the obligations and responsibilities of law. Purposes of processing

The Personal Data you provide through the site will be processed by Jesolo Real Estate for the following purposes

a) purposes related to the execution of a contract to which you are a party or to the execution of pre-contractual measures taken at your request or in any case to the fulfilment of a request made by you through the site (e.g.: contact request through the contact forms);

b) purposes of sending advertising material by e-mail, only if consent is given by ticking the appropriate box;

c) purposes of statistical research/analysis on aggregate or anonymous data, without therefore the possibility of identifying the user, aimed at measuring the functioning of the website, measuring traffic and assessing usability and interest

d) purposes relating to the fulfilment of a legal obligation to which the Data Controller is subject;

e) purposes necessary for establishing, exercising or defending a right in court or whenever the judicial authorities exercise their jurisdictional functions.

The legal basis for the processing of personal data for the purposes under a) is the provision of a service or the response to a request that does not require consent under applicable law; the purpose under c) does not involve the processing of personal data, while the purposes under d) and e) are a legitimate processing of personal data under applicable law because, once the personal data is provided, the processing is necessary to fulfil a legal obligation to which Jesolo Real Estate is subject.

The purpose referred to in point e) is also based on the legitimate interest of the Controller.

The purpose referred to in point b) is based on the data subject’s consent; consent given for this purpose may be revoked at any time by the data subject by writing to the Data Controller at the contact details given in point 1, but revocation will not affect the lawfulness of processing carried out before revocation.

Obligatory/voluntary nature of providing data

The provision of your personal data for the purposes referred to in letters a), d) and e) above is compulsory in order to be able to use the requested service;

The provision of your personal data for the purposes referred to in point b) above is optional and failure to provide it does not prevent the provision of the requested services.

Persons who may become aware of your data

The following may become aware of your personal data

a. subjects whose intervention is necessary for the provision of services offered by the Site including, for example, the sending of e-mails and analysis of the operation of the site acting as data processors of Jesolo Real Estate;

b. persons authorised by Jesolo Real Estate to process personal data who have committed themselves to confidentiality or are under a legal obligation of confidentiality (e.g. employees and collaborators of the Controller)
c. judicial authorities in the exercise of their functions when required by Applicable Law.

The data you voluntarily provide by filling in the forms on the website will be communicated to the following parties

1- filling in and sending the “contact us” form:

– if you do not insert any flag (except for the one, compulsory, on acceptance of the site’s conditions of use: only to the advertiser;

– if you insert the flag on the box “I need a mortgage”: to Jesolo Real Estate’s partner credit brokers.

The subjects who receive the aforementioned communications of personal data become autonomous data controllers and will be obliged to provide their privacy policy. Jesolo Real Estate is not responsible for the data processing carried out by them.

1- filling in and sending the “Search/Offer” or “Offer” form: the data entered are sent by e-mail to the agency and are also available for consultation by the same.

The data are not subject to dissemination.

Automated tools

No automated decision-making processes are applied in the processing of personal data for the purposes set out in this notice.

Data retention periods

Personal data collected during navigation on the www.jesolorealestate.it website will be kept for the time strictly necessary to pursue the aforementioned purposes.

The data provided shall be kept for the time necessary to provide the services covered by the contracts, to fulfil the legal obligations imposed on the Data Controller such as tax, fiscal, civil law obligations of bookkeeping and correspondence, etc., as well as to protect the legitimate interests of the Data Controller such as the defence of its rights arising from contracts with the Interested Party or for the protection of its rights before the competent Authorities (this within the limits of the limitation period of third party claims against the Data Controller e.g. right to compensation for non-contractual damages, right to compensation for contractual damages).

The data collected for sending commercial/promotional e-mails will be processed for a maximum period of 18 months, unless the data subject decides to unsubscribe earlier by using the appropriate link at the bottom of each e-mail sent or by writing to the data controller at the contact details above.

Rights of the data subject

As a data subject with regard to the processing of your personal data you have the right to obtain confirmation of the existence or non-existence of your personal data, to know its content, to verify its accuracy, to access your data, to ask for its origin, rectification, integration, deletion, the purposes and methods of processing, updating if incomplete, incorrect or collected in violation of the law as well as to object to its processing and to obtain the limitation of its processing; you have the right to the transformation into anonymous form and the blocking of data processed in violation of the law; finally, you have the right to the portability of your data.
